Effective Dates

The following rates are effective as of December 1, 2016 and supersede all previous rate and fee schedules. This rate schedule applies to all transactions unless otherwise negotiated. Sales tax will be applied to all relevant fees.

Sales Tax Affirmation

Please Note: Your local sales tax rate is available at https://www.tax.ny.gov/ Leaving FCS Web Site . Services that produce a physical deliverable (such as a web site, printed material, or electronic documentation) require the collection of local sales tax. Services without a physical deliverable (such as customer support, advice, and meetings) may not require the collection of local sales tax. FCS does not support, condone, or encourage avoidance of sales tax collection. Your understanding in this matter is appreciated.

If your organization is exempt from sales tax (non-profits, government entities, etc.), you must provide a copy of the exemption form prior to the start of the engagement.

Project Management Services

If you have a larger project or engagement in mind, FCS may be able to work with your contracted vendor to augment their services. FCS may also be able to provide Internal Control assistance in monitoring the engagement of other vendors. FCS does not provide 24/7 support for any services. Support is determined for each engagement and may be negotiated at the time of the engagement.   If you have any questions, please email fcs@firstduty.com and I will be happy to discuss options with you.

* The billable rate markup applies to contracts requiring the sub-contracting of other companies or individuals. The billable rate markup applies only to labor contracted out as defined in the engagement. It does not apply to direct labor provided by FCS and its staff. Direct labor provided by FCS and its staff is at the Standard Labor Rate.

Device Services

  • Standard Labor - Business Rate ($85/hour)
  • Standard Labor - Residential Rate ($45/hour)
  • Contract Labor - Billable Rate Markup (48%)*
  • PC/Laptop Scan & Cleanup: This service assumes that the client has current licensing for security and maintenance software. ($125 + labor or by contract)
  • Purchase Review ($25 + labor)
  • Purchase Assistance and Accessibility Service (labor)
  • PC Diagnostic/Inspection Fee: Includes system review onsite or inhouse, troubleshooting review, and non-intrusive diagnostics. Includes desktops and laptops. This service assumes that the client has current licensing for security and maintenance software. If additional licensing or purchases are required, those costs will be passed to the client. FCS requests client approval prior to any additional purchases. All software/hardware so purchased or licensed is the sole ownership/responsibility of the client after the engagement. ($125 + labor + cost)
  • System/PC Maintenance Fee: Applies to Software Installations/Updates, Hardware Installations/Updates, Infection Removals. This service assumes that the client has current licensing for security and maintenance software. If additional licensing or purchases are required, those costs will be passed to the client. FCS requests client approval prior to any additional purchases. All software/hardware so purchased or licensed is the sole ownership/responsibility of the client after the engagement. ($125 + labor + cost)

Labor Rates

Labor is billed for a minimum of one (1) hour. After the first hour, labor is billed in 15 minute increments with a 15 minute discretionary period. Discretionary period is at the sole discretion of FCS.

Additional Fees and Discounts

Discounts are NOT cumulative. The highest available discount is applied. Discounts will not be provided retroactively on invoices already issued. All discounts must be negotiated prior to the start of service/work.

  • Negotiated fee schedules may also be available on a case by case basis. FCS will work with you for an affordable solution.
  • Travel Fee: A travel fee will be included for any engagement outside of the local service area. FCS reserves the right to waive the fee at its sole discretion. FCS reserves the right to impose the travel fee within the local service area for no-show or cancelled engagements unless prior arrangements are made. For purposes of this fee, the local service area includes Fulton, Montgomery, Schenectady, and Albany counties within the state of New York. ($25 + $10 / county border)
  • Location Discount for Fulton County, NY (5% + no travel fee)
  • Location Discount for Montgomery County, NY (5% + no travel fee)
  • Location Discount within 10 miles (5% + no travel fee)
  • United States Military Family Discount: FCS thanks you for your service. Includes all branches, active military, retired/discharged military, and their families. Families include those in the same household, children, and parents. (50% labor + no travel fee)
  • Emergency Services Family Discount: FCS thanks you for your service. Includes organizations considered first responders as well as pre-approved disaster relief organizations. Examples include law enforcement, fire response, and the American Red Cross. Families include those in the same household. (50% labor + no travel fee)

Right to Decline Service Statement

FCS reserves the right to decline a client or project based on potential or real conflicts of interest with existing clients, projects, service load (a.k.a. workload), or applied codes of conduct. If FCS cannot do a project for any reason, you will be notified and receive a plan for what we can do to help your project be a success.

Payment for Service Agreements

As a condition of service, all clients agree to pay for the services received at the rates specified.

As a condition of service, all clients and web users must agree to the Arbitration, Settlements, and Conflict Resolution section of this document. If you do not agree, you must notify FCS and service will be terminated. You are responsible for any fees incurred until that point in time plus any penalties that may apply. If you are a web user and you do not agree, you must leave the FirstDuty website.

Disclaimers

Right to Decline Service

FCS reserves the right to decline a client or project based on potential or real conflicts of interest with existing clients, projects, service load (a.k.a. workload), or applied codes of conduct. If FCS cannot do a project for any reason, you will be notified and receive a plan for what we can do to help your project be a success. FCS reserves the right to refuse, terminate, or modify any work effort for the following reasons. This includes contracted work and changes to the scope of existing work efforts. All valid contracts must include a section allowing for the amicable termination of the contract under these conditions.

  • Conflicts of Interest identified at any time during the engagement or preliminary research. Conflicts of Interest may include, but are not limited to the following. Note that some of these are due to existing obligations or contracts. All Conflicts of Interest will be decided on a case-by-case basis.
    • Any project that directly involves processing information from, or reporting to, a New York State or New York State County level government entity.
    • Companies or organizations that may be in direct competition with an existing customer who has a current in-progress engagement.
    • Companies or organizations that may have an active investigation pending against them that is related to the requested engagement.
  • Illegal or unethical practices by the customer or its direct partners, intentional or unintentional.
  • Breach of Contract by customer.
  • Mutual agreement of FCS and customer.
  • Acts of God, nature, or war that prevent effective continuation of the engagement.

Discovery

Discovery services refer to the assessment of devices or project work. This is not the same as "legal discovery" or "eDiscovery". These terms refer to the legal or security processes involved in legal and hold actions. FCS does not provide these legal services.

Arbitration, Settlements, and Conflict Resolution

In the event that there is a disagreement over billing or service issues, the following options are available to all registered clients. A registered client shall include all clients that have entered into an agreement with FCS and who have begun receiving that service with an expectation by FCS of payment due.

  1. If there is a billing issue, please review your bill one more time. If there is a service issue, please review your client agreement one more time. If the issue has not been resolved, then ...
  2. Contact FCS and explain the issue (see Payment Address and Inquiry Information below). Please include your contact information, dates, and a full description of the problem. FCS will work with you in a good faith effort to successfully resolve the issue. You are important and FCS wants you to know that.
  3. In the event that we are not able to resolve the issue using any of the methods above, the following options are available to you. All arbitration related to FCS will take place in Fulton County, New York, U.S.A.. All refunds, penalties, and liabilities are limited to the amount billed for Labor.
    • If you believe that FCS has acted unethically regarding a service provided, you may contact the Better Business Bureau Leaving FCS Web Site to file a report.
    • If you believe that FCS has acted unethically regarding a project management service provided, you may contact the Project Management Institute Leaving FCS Web Site to file a report.
